Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed through Socialvantix. The provider is Mavilab, owner Özgür Abuska, Straße im Loh 21, 63179 Obertshausen, Germany.
2. Definitions
A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business, or profession. A trader is a natural or legal person, or a legally recognised partnership, acting for purposes relating to their trade, business, craft, or profession when entering into the transaction.
3. Description of services
Socialvantix provides digital social media marketing services such as followers, likes, views, subscribers, comments, or similar interactions for public social media content. The specific service, quantity, platform, delivery time, and any quality characteristics are set out in the respective product description.
Socialvantix is not affiliated with Instagram, TikTok, YouTube, Facebook, X/Twitter, Twitch, or any other platform mentioned. Our services do not guarantee any specific reach, engagement rate, increase in sales, brand awareness, or lasting visibility on any platform.
4. Formation of contract
The presentation of products in the shop does not constitute a legally binding offer, but an invitation to order. The customer submits a binding offer by completing the checkout process. The contract is formed when Socialvantix accepts the order, carries out the service, or sends an order confirmation.
5. Customer information and obligations to cooperate
The customer is obliged to provide complete and accurate information. This includes in particular the correct target URL, the correct public username, the desired quantity, and, where applicable, requested comment text. The target profile or content must remain publicly accessible during processing and must not be deleted, renamed, blocked, or set to private.
Passwords are never required and must not be transmitted. The customer is solely responsible for ensuring that the ordered content, profiles, and target pages do not violate any laws, third-party rights, or platform rules.
6. Incorrect links, private profiles, and blocked accounts
If an order cannot be carried out due to incorrect information, inaccessible content, private profiles, deleted posts, blocked accounts, or similar circumstances, we will attempt to contact the customer where possible. Socialvantix is not responsible for any resulting delays.
If an incorrect link is provided and the service has already been delivered to the specified target, there is no entitlement to a free re-delivery. A correction is only possible as long as processing has not yet begun.
7. Delivery and delivery times
Delivery times are estimates unless explicitly stated as binding. The start and speed of delivery may vary depending on platform, product, current load, security checks, payment status, and the accessibility of the target profile. Partial deliveries are permitted where reasonable for the customer.
8. Concurrent orders and third-party providers
While an order is in progress, the customer should not place similar orders for the same target with other providers. Concurrent orders may affect measurability, delivery quality, and refill verification. Socialvantix cannot reliably attribute any resulting discrepancies to its own service.
9. Payment terms
The prices and payment methods shown at checkout apply. Service delivery generally begins after successful payment or payment authorisation. Delays caused by payment service providers, checks, or failed payments may postpone the start of delivery.
10. Comments and custom content
For services involving custom comments, the customer is responsible for the text submitted. Content that is unlawful, offensive, discriminatory, misleading, or infringes third-party rights may be rejected. Socialvantix is not obliged to review such content but reserves the right to reject it or request changes.
11. Refill and replacement
Where a refill or replacement guarantee is stated for a product, it applies exclusively for the duration and scope specified in the product description. It requires that the customer report the loss within the specified period, that the target remains publicly accessible, and that no similar services from third-party providers were used in parallel.
A refill is excluded if the drop was caused by deletion, blocking, renaming, setting the profile to private, platform action, a change to the target URL, third-party services, or the customer’s own actions.
12. Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal. Details can be found in our Right of Withdrawal notice. For digital services, the right of withdrawal may expire before the withdrawal period ends if the customer expressly requests that performance begin before the withdrawal period ends, and confirms that they will lose their right of withdrawal once the contract has been fully performed.
13. Warranty
Statutory warranty rights apply. For digital brokerage services, the service owed consists of arranging or carrying out the ordered service in accordance with the product description, not a specific economic or organic result on a social media platform.
14. Liability
Socialvantix is liable without limitation for intent, gross negligence, injury to life, body, or health, and under mandatory statutory provisions. In the event of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded to the extent permitted by law.
Socialvantix is not liable for actions, changes, blocks, deletions, reach restrictions, or other decisions made by social media platforms.
15. Indemnification
The customer indemnifies Socialvantix against third-party claims arising from unlawful use of the services, from content provided by the customer, or from violations of third-party rights, to the extent the customer is responsible for the violation.
16. Customer account
Where a customer account is offered, the customer is obliged to keep their login credentials secure and protect them from access by third parties. Order data and status displays in the customer account are for informational purposes and may change during technical checks.
17. Platform changes
Social media platforms may change their rules, algorithms, interfaces, visibility, and verification mechanisms at any time. Such changes may affect delivery time, visibility, stability, or counting methods and are beyond the control of Socialvantix.
18. Contract language and storage
The contract language is German. Socialvantix is not obliged to permanently store the contract text for retrieval by the customer. Customers receive the essential order data as part of the order process.
19. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection granted by mandatory consumer protection provisions of the country in which they habitually reside.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
